Terms & Conditions

Rules governing access to and use of the Encoreats marketplace, websites, apps, ticketing, partner and event services.

1. Agreement and scope

These Terms form a binding agreement between you and ENCOREATS PRIVATE LIMITED (“Encoreats”, “we”, “us”, or “our”) when you access or use any Encoreats website, mobile application, partner interface, ticket, QR credential, membership, marketplace, booking, reservation, event, support, or related service (“Services”). Additional event, membership, booking, partner, promotional, or payment terms shown before a transaction also apply.

2. Marketplace role

Encoreats operates a technology-enabled marketplace connecting users, artists, venues, event organisers, and service partners. Unless expressly identified as the organiser, venue, artist, seller, or principal supplier for a transaction, Encoreats facilitates discovery, contracting, payment processing, ticketing, communication, and support and does not itself perform the underlying live performance or venue service.

3. Eligibility and age

You must be legally capable of entering into a contract under Indian law. Users below eighteen years must use the Services only through a parent or lawful guardian where permitted. Event-specific minimum-age, alcohol, identification, and entry rules apply independently and may be stricter.

4. Accounts and identity

You must provide accurate information, keep credentials and one-time passwords confidential, and promptly update material changes. You may not create false accounts, impersonate another person, transfer an account without permission, or bypass verification. You are responsible for activity carried out through your account unless you promptly report unauthorised access.

5. Listings, availability and pricing

Event, artist, venue, table, package, membership, capacity, timing, facility, accessibility, and pricing information may be supplied by third parties. We use reasonable measures to present accurate information, but availability and final terms are confirmed only when the relevant booking or order is successfully created. Mandatory taxes, fees, and convenience charges will be disclosed before payment.

6. Bookings, tickets and QR credentials

A payment authorisation or successful checkout screen does not by itself guarantee confirmation. A booking is confirmed only when Encoreats issues a valid confirmation and, where relevant, a ticket or QR credential. Tickets and QR credentials may be personal, revocable, non-transferable, or subject to transfer rules stated for the event. Duplicating, altering, reselling unlawfully, or using a ticket after refund or cancellation is prohibited.

7. Payments, subscriptions and payouts

Payments may be processed by authorised banks, payment aggregators, gateways, or other providers. You authorise the applicable charge and agree to provider terms. Recurring plans renew only where clear authorisation has been obtained. Artist, venue, organiser, and partner payouts remain subject to completed verification, applicable deductions, dispute holds, reconciliation, provider processing, and law.

8. Cancellation, refund and event change

Cancellation and refund rights depend on the product, event, booking stage, organiser or partner terms, and applicable law. The Refund & Cancellation Policy forms part of these Terms. Event timing, lineup, venue, seating, access, or format may change for operational, safety, legal, or force-majeure reasons. Material changes will be communicated through available channels.

9. Conduct and prohibited use

You must comply with the Community Guidelines, Acceptable Use Policy, venue rules, event instructions, and applicable law. Fraud, harassment, threats, discrimination, dangerous conduct, illegal goods or services, ticket manipulation, scraping, malware, spam, account abuse, and infringement of intellectual-property or privacy rights are prohibited.

10. User and partner content

You retain ownership of content you lawfully own. By uploading or submitting content, you grant Encoreats the limited, worldwide, non-exclusive, royalty-free licence described in the Content Usage Policy to host, process, reproduce, display, adapt for technical formats, distribute, and promote that content for operating and marketing the Services. You must have all required rights and consents.

11. Suspension and termination

We may restrict, suspend, remove content from, or terminate access where reasonably necessary for security, suspected fraud, legal compliance, breach of these Terms, risk to users or partners, non-payment, repeated complaints, or platform integrity. Where appropriate, we may provide notice and an opportunity to respond or appeal.

12. Disclaimers and liability

The Services are provided on an “as available” basis to the extent permitted by law. Nothing excludes liability that cannot lawfully be excluded, or limits statutory consumer rights. Subject to that restriction, Encoreats is not responsible for indirect or consequential loss, third-party acts, personal property, travel, weather, network or provider outages, or information outside our reasonable control.

13. Indemnity

To the extent permitted by law, business users and partners agree to defend and indemnify Encoreats against third-party claims arising from their unlawful content, breach of contract, tax or licence non-compliance, infringement, event operations, or misconduct. This clause does not reduce any non-waivable consumer right.

14. Governing law and disputes

These Terms are governed by the laws of India. Courts at PATNA,BIHAR will have jurisdiction, subject to mandatory consumer-jurisdiction rules and any applicable online dispute or statutory forum. Parties should first use the Encoreats grievance process.
